Introduction 

The website: https://www.vinyasahealth.com  (“Website”) together with the dashboard by the same name (“Dashboard”) (Website, and Dashboard are collectively referred to as the “Platform”) is owned, operated, and managed by us i.e., Brandorate Ventures Private Limited, a company incorporated in India under the Companies Act, 2013, and having its registered office at [Petlad, Nadiad, Anand, Gujarat – 388 450]  (“Vinyasa Health”).

This Policy (as defined below) is applicable to all the users who access or use the Platform including you (“Users”). For purposes of this Policy, “you” and “your” means you as a User of the Platform, “we”, “us” or “our” refer to Vinyasa Health or its subsidiaries, parent or group entities, or affiliates as deemed so by Vinyasa Health.  

If you continue to access, browse, and use this Platform for all the services and products offered and supplied via the Platform, and to transact with such products and services (collectively, the “Services”), you are agreeing to comply with and be bound by this privacy policy (“Policy”), which together with our terms of use (collectively, “Platform Policies”) govern Vinyasa Health’s relationship with you in relation to the usage of this Platform. 

Capitalized terms if used but not defined herein shall have the same meaning ascribed to them in the terms of use or such other Platform Policies (as updated regularly). 

Scope 

This Policy provides how we handle the Personal Data (as defined below) collected from you while you are accessing or using the Platform or availing the Services. It is advisable that you read this Policy carefully, because if and whenever you use our Platform or avail the Services, your Personal Data will be processed in accordance with this Policy. By using or accessing the Platform or availing the Services, you agree to be bound by the terms of this Policy. You should not use the Platform or avail the Services if you do not agree with this Policy, the other Platform Policies, or any other agreement that governs your use of the Platform or the Services. 

This Policy is limited only to Personal Data that Vinyasa Health collects from its Users who use or access the Platform or avails the Services. This Policy is governed by the applicable provisions of the Information Technology Act, 2000 read with the Digital Personal Data Protection Act, 2023 (as notified) and the rules framed under these statutes. 

Rights of the Users 

When you use our Platform or avail our Services, you have the following rights: 

1. Right to access information about your Personal Data. Subject to applicable laws, you may at any time raise a request for: (i) a summary of your Personal Data being processed by us and the processing activities undertaken by us with respect to your Personal Data; (ii) identities of third parties with whom your Personal Data has been shared along with a description of the Personal Data shared; and (iii) any other information regarding your Personal Data and its processing.
2. Right to correction and erasure of Personal Data. You have the right to correction, completion, updation, and erasure of your Personal Data for which you have previously given us consent. We will at our end proceed to erase your Personal Data stored by us (including those stored with third parties to whom we had shared your Personal Data for processing on our behalf) within such reasonable time once the purpose for such data is no longer being served subject to applicable laws and this Policy.
3. Right of grievance redressal. You have the right to readily available means of grievance redressal in respect of any act or omission of ours regarding the performance and obligations in relation to your Personal Data.
4. Right to nominate. You may nominate, in such manner as may be prescribed, any other individual, who shall, in any unfortunate event of death or incapacity exercise rights on your behalf in accordance with the applicable law. We will request details of your nominee at the time of obtaining your consent.
5. Right to withdraw consent. You have the right to withdraw your consent at any time. Once you have withdrawn your consent, we will cease to use, collect, process, or store your Personal Data subject to applicable laws and this Policy.

If you wish to exercise any of the above rights, you may write to our Grievance Redressal Officer as identified in this Policy and subject to applicable laws, and terms of this Policy, we will process your request in accordance with our internal grievance redressal process. 

Duties of the Users 

You hereby agree and undertake that you will comply with all the applicable laws pertaining to your use and disclosure of your Personal Data while using the Platform or availing the Services. You agree that you will not impersonate another person while sharing your Personal Data. You also agree that you will not suppress any material information while providing your Personal Data. You will furnish only such information as is verifiably authentic, while exercising the right to correction or erasure under this Policy, subject to applicable laws. 

Collection of Personal Data 

Vinyasa Health may collect Personal Data directly from you or automatically from your devices when you interact with our Platform or avail our Services. The nature of Personal Data we collect from you may depend on how you use our Platform or avail our Services.  

While you may not be required to provide certain information and could engage with our Platform or Services anonymously, some data is necessary for the purposes described in this Privacy Policy. Without providing this information in accordance with our Privacy Policy, you may not be able to fully access our Platform or avail our Services. 

Following is the Information we collect:

When you use, access, interact, or register on the Platform or avail the Services, we generally collect the following information (“Personal Data”): 

• First and last Name, email address, postal address, phone number, social media profile links, and profile picture;  

• Age, gender, pronouns; 

• Device model, OS version, browser type, browsing and search history; 

• Interests inferred from online behaviour; 

• Job title, professional licenses, experience and educational qualifications; 

• Location based on IP address, state, city, local time, and time zone; 

• Specialty, referral information, current practice setting, whether you are certified, and information regarding how you learned about Vinyasa Health; 

• Inquiry and communications data including information provided in chat messages or to our email addresses, or via phone; 

• Details of all the appointments booked with the service providers registered on the Platform;  

• Feedback and ratings you provide relating to our Services or products; 

• Payment information including Name, contact details, email address, and GST number (if applicable); 

• Publicly available information, data obtained through brand partnerships and corporate transactions; 

• Deidentified Information which is stripped of identifying elements, ensuring it cannot link back to a consumer or household.  

We also collect data to analyse traffic and usage patterns for our Services and to understand our Users better. Sometimes, we use tools like Google Analytics to assist with this. Payment Information 

To avail of our Services, you may be required to complete a payment through online third-party payment platforms or service providers. For this purpose, you may be redirected to third-party payment gateways or interfaces. These third-party payment platforms or service providers may collect your billing details, such as your billing name, address, and payment information (“Billing Information“) for processing your payments. 

By proceeding with a payment, you acknowledge and consent to your Billing Information being provided to third-party payment platforms or service providers solely for the purpose of processing your payment for the Services. You consent to the collection and processing of your Billing Information by these third-party payment platforms or service providers. Please note that the submission of your Billing Information is subject to the privacy policies and terms of use of the respective third-party payment platforms or service providers. 

How We Collect Your Information? 

We may collect your Personal Data through various methods to provide and enhance our Services or the Platform experience. The source of collection shall depend on how you use our Services. These include:

We use two types of cookies: persistent cookies, which save your login credentials for future sessions, and session cookies, which enable features of the Platform, help us understand how you interact with our Services, and monitor overall usage and traffic. In such cases, by using the third-party services through our Platform, you consent to their privacy policies and terms of use. Vinyasa Health is not liable for any issues arising from the use of these third-party services and we strongly encourage you to review their respective privacy policies and terms. 

The information we automatically collect through these tools helps us enhance your customer experience. For instance, we may use this data to personalize and improve your user experience, monitor and optimize our Services, and increase the effectiveness of our offerings, advertising, communications, and customer support. Additionally, we may use the data gathered from tracking technologies to: (a) remember information so you won’t need to re-enter it during or on future visits; (b) deliver tailored content and targeted advertising; (c) recognize you across different devices; (d) assess and improve our Services’ performance; (e) track aggregated metrics like visitor counts, traffic, usage, and demographics; (f) troubleshoot technical issues; and (g) support future Service enhancements and planning.

Storage and Processing of Personal Data 

The Personal Data collected by us will be mostly stored electronically. All such Personal Data shall be transmitted and stored by us in encrypted and anonymised form in accordance with the applicable laws to ensure the secrecy and confidentiality of the Personal Data and such information shall not be shared or used except as provided herein. 

Subject to applicable laws, we may engage into arrangements with third parties (within or outside India) to collect, store, or process your Personal Data. Any Personal Data transferred to such third parties for processing will only be done if such third parties already have in place such reasonable security standards as may be necessary to avoid any breach or unauthorised disclosure of your Personal Data and complying with the applicable laws. By accepting this Policy, you expressly consent to and authorise the sharing of your Personal Data with such third parties for such collection, storage, and processing. 

Data Usage 

We use, collect, store, and process your Personal Data only for the following purposes:

• provide Personal Data collected on the Platform to Vinyasa Health’s affiliates, other third parties, including those who are working with Vinyasa Health;  

• to provide appropriate support, guidance, and resources for therapists using the Platform; 

• to implement and enforce the Platform’s Terms of Use, Privacy Policy, and other relevant agreements; 

• for other purposes including but not limited to conduct market research, inform our marketing and advertising activities, to data analysis, observing usage trends and to evaluate and improve the Services on the Platform or any other Services offered by Vinyasa Health; and product development.

We do not use Google Workspace APIs to develop, improve, or train generalized artificial intelligence (AI) and/or machine learning (ML) models. Any data accessed through Google Workspace APIs is only used for the specific purposes outlined in this Privacy Policy and in compliance with Google API Services User Data Policy.

Data Retention 

Unless necessary for compliance with applicable laws, we will retain your Personal Data only for the duration required to fulfil the specified purpose for which it was initially gathered with your consent. We hereby affirm that our practise is to retain Personal Data solely for the duration required to fulfil the intended purpose and that we maintain rigorous protocols for review and retention in order to fulfill these obligations. ​     ​

We shall erase all Personal Data collected from you in case you withdraw the consent unless such Personal Data is required for completing the specified purpose for which you had previously consented or towards compliance of any subject to applicable laws.  

Sharing of Personal Data 

We may share your information for the following purposes: 

• in response to an order, decree, judgment, or subpoena issued by a court or governmental authority for:
  (i) enforcing any legal claims or rights;
  (ii) its performance of any judicial or quasi-judicial or regulatory or supervisory function;
  (iii) prevention, detection, investigation, or prosecution of any offence or contravention of any applicable law.; or
  (iv) enforcement of any national security interests; 

• in relation to any negotiations of a merger, demerger, sale of assets, financing, restructuring, or sale of all or part of our business or any part of it; 

• for research, archiving, or statistical purposes subject to applicable laws and standards; and/or 

• internally within our organization to provide you need-to-know products, Services, offers, or promotions.  

Security and Confidentiality 

We ensure to undertake all reasonable security practices and procedures including but not limited to appropriate technical and organizational measures to ensure that your Personal Data is protected. We will update these measures as new technology becomes available, as appropriate.  

Consent 

We only collect Personal Data with your free and express consent in writing through email or consent form or any other appropriate means (as notified to you). You agree that we may continue to process your Personal Data until you withdraw your consent. 

1. We do not collect Personal Data unless you give us your express consent and only in a situation where collection or processing of such Personal Data is required by us such as:
   (i) for a lawful purpose which you have shared your consent or a legitimate use connected with our function or activity or any person on our behalf; and

Children’s Personal Data  

Vinyasa Health’s Platform is not directed at children under the age of 18, and we do not intentionally collect or solicit personal information from anyone under this age. We encourage parents and guardians to supervise the online activities of minors and to consider using parental control tools provided by device manufacturers or software providers to help create a safe online environment. If a child under the age of 18 has provided us with personal information, we ask that their parent or guardian contact us so that we can remove the information from our systems. If we come to the knowledge that any information we hold was collected from a child under the age of 18, we will promptly delete it to ensure their privacy.  

Casual Visitors 

Vinyasa Health does not collect Personal Data from casual visitors browsing the Platform (“Casual Visitors”). 

However, certain provisions of this Privacy Policy may still apply to Casual Visitors. It is important for Casual Visitors to read and understand the Privacy Policy and our Terms of Use carefully. If you do not agree with these terms, you are advised to leave the Website immediately. 

If you, as a Casual Visitor, have browsed any page of this Website before reviewing this Privacy Policy and do not agree with how your information may be obtained, processed, stored, or used, closing your browser should ordinarily clear all temporary cookies installed by Vinyasa Health. We recommend using the “clear cookies” function in your browser to ensure that all cookies are deleted, as Vinyasa Health cannot control or predict the behaviour of your device. 

You will no longer be considered a Casual Visitor if you submit any Personal Data to Vinyasa Health, whether through email, registration, or other means or continue to use and access our Platform or Services enabling us to collect, store or process your Personal Data. In such cases, you will be treated as a User, and all provisions of this Privacy Policy will apply to you. 

International Users 

Most of our Platform Services are hosted in India. If you are accessing the Platform or availing Services from outside of India, where laws or regulations governing Personal Data collection, use, storage, retention, and disclosure differ from Indian laws, please be advised that your continued use of the Platform or Services may be governed by Indian law, this Policy, the Platform Policies, and any other terms and conditions applicable to our Services.  

Public Information

You are solely responsible for any information, including any Personal Data, you disclose on the public areas of the Platform, and any use of such information by any third-parties regardless of whether you permitted or did not permit such use. The Vinyasa Health Platform may contain links to external websites (“Third-Party Websites“) that are not under our control, and we are not responsible for the content, accuracy, or any updates on these Third-Party Websites, including any links they may contain there. The inclusion of such Third-Party Websites does not imply endorsement, referral, or affiliation with such Third-Party Websites. When accessing these Third-Party Websites, you will be governed by their respective terms of use, privacy policies, and any additional policies. We strongly advise you to review these policies carefully before interacting with these Third-Party Websites. 

Review/Updates 

Vinyasa Health may modify, amend, alter, or update this Policy at any time at its own sole discretion. The updated Policy will be displayed on the Platform and by continuing to use the Services and/or accessing the Platform, you agree to be bound by any such changes/updates made by Vinyasa Health. It is your responsibility to regularly check for such changes/updates. You agree that your continued use signifies acceptance of those changes/updates.  You must discontinue using or accessing the Services or Platform if you disagree with such changes/updates to this Policy.
